A lawsuit gets Blue Crushed

By Blake Fontenay
September 9th, 2008

“OK, everybody, calm down. This is not what it looks like.”The person or people who run the MPD Enforcer 2.0 blog got a bit of good news yesterday when the City of Memphis decided to drop the last vestige of its lawsuit against them.

The city’s lawsuit claimed the blog, which is often critical of the Memphis Police Department, was violating trademark and other laws by using Police Director Larry Godwin’s image and MPD’s Blue Crush logo. (I actually had some designs on the Blue Crush logo myself, for a new line of blueberry jam I was thinking about marketing and selling. But that’s neither here nor there.)

The lawsuit also claimed the blog had outed an MPD undercover officer by posting the officer’s photo, even though MPD also posted a photo of the officer on its own Web site and the officer had been mentioned in news reports as an undercover agent. (And, by the way, the blog photo was apparently taken at a party attended by a bunch of other cops. Would Rico or Sonny have ever been so indiscreet?)

Anyway, I guess the MPD Enforcer 2.0 blogger(s) are in the clear, at least as far as the courts are concerned. Then again, Godwin could just sic his good friend, actor and martial arts expert Steven Seagal, on them, so they’d better watch out.
